1. Introduction

Welcome to Ogar ("we", "our", "us"). By accessing or using ogar.in (the "Platform"), you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Platform.

Ogar is a free online platform that connects people looking for rooms ("Seekers") with people who have rooms to rent ("Listers") in Pune, India.

2. Eligibility

By using Ogar, you confirm that you are legally capable of entering into a binding agreement under applicable Indian law. Minors must use the Platform only with the involvement and consent of a parent or legal guardian. If you are using the Platform on behalf of someone else, you confirm that you have the authority to do so.

3. Nature of the Platform

Ogar is a listing and discovery platform only. We are not a real estate agent, broker, or party to any rental agreement between Seekers and Listers. We do not guarantee the availability, accuracy, or suitability of any listing.

All transactions, agreements, and arrangements are solely between the Seeker and the Lister. Ogar bears no responsibility for any disputes, losses, or damages arising from such arrangements.

4. User Accounts & Verification

• You must provide a valid email address to register. An OTP will be sent to your email to verify your identity.
• A valid phone number must be provided at the time of registration. This is used for internal review and verification purposes by the Ogar team and is not shared with other users without your explicit consent.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must not share your account with or transfer it to any other person.
• We reserve the right to suspend or terminate accounts that violate these Terms.

5. Listings

• All listings are manually reviewed by the Ogar team before going live on the Platform.
• Listers must ensure that their listings are accurate, truthful, and not misleading.
• Ogar uses AI to extract and structure details from listing text. While we aim for accuracy, we do not guarantee that all AI-extracted details are error-free.
• Ogar reserves the right to remove any listing at its sole discretion without prior notice.
• Listings must not contain illegal content, discriminatory language (beyond lawful gender preferences), or fraudulent information.

6. Applications & Contact Sharing

• Seekers may apply for a room listing. Ogar auto-generates a personalised introduction message to accompany the application.
• In-app chat is only enabled after the Lister explicitly approves a Seeker's application.
• Phone numbers and other contact details are only shared when both the Seeker and the Lister explicitly opt in. Neither party's contact details are shared by default.
• You must not misuse contact information shared through the Platform for spam, harassment, or any unlawful purpose.

7. Prohibited Conduct

You must not:

• Post fake, duplicate, or misleading listings.
• Use the Platform for any illegal activity under Indian law.
• Harass, threaten, or abuse other users.
• Attempt to scrape, copy, or redistribute content from the Platform without our prior written consent.
• Circumvent any verification, review, or approval mechanism on the Platform.
• Impersonate any person or entity, or misrepresent your identity or affiliation.

8. Intellectual Property

All content on the Platform, including the Ogar name, logo, design, AI features, and underlying software, is the property of Ogar and is protected by applicable intellectual property laws. You may not reproduce or use any part of the Platform without our prior written consent. User-generated content (such as listing text) remains the property of the respective user; by posting it, you grant Ogar a non-exclusive licence to display and process it on the Platform.

9. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without any warranties of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components. We do not verify the identity of users beyond the verification steps described above, and we make no representation as to the character or intentions of any user.

10. Limitation of Liability

To the fullest extent permitted by law, Ogar shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of or inability to use the Platform, including any loss arising from reliance on any listing, user, or communication on the Platform.

11. Indemnification

You agree to indemnify and hold harmless Ogar, its team members, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.

12. Changes to Terms

We may update these Terms at any time. Continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms. We recommend reviewing this page periodically.

13. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra.
